These Terms and Conditions ("Terms") govern the services provided by Apex Refund Advisory ("we", "us", "our") to you ("the client"). By signing our Authority to Release, or by instructing us to proceed with our services, you agree to these Terms.

1. Our service

We provide an investigation, lodgement and recovery service for unclaimed money and assets that may be held in your name by government bodies, registries or other holders. This includes making the necessary inquiries, investigations and procedures for the purpose of identifying and recovering unclaimed monies to which you may be lawfully entitled.

2. Your authority

By signing the Authority to Release, you authorise us and our authorised representatives to act on your behalf to investigate and recover unclaimed money held in your name. You confirm that you are the rightful owner of, or the authorised signatory for, the funds concerned.

3. Fees

Our service fee is 20% of funds successfully recovered, for both individuals and businesses.
No fees are payable if funds are not successfully recovered.
Our fee is invoiced upon receipt of the recovered funds (by cheque or EFT) and is payable in full within seven (7) days of receipt.
You remain the rightful owner of any funds recovered.

4. Your responsibilities

You are solely responsible for the accuracy of all information you provide. Any errors or omissions may result in delays or failure in the recovery of funds. You agree to provide valid and legally recognised identification documents as may be required to facilitate the verification process.

5. Identification & verification

To comply with the requirements of the bodies holding unclaimed money, we may need to verify your identity and your entitlement to the funds. We will let you know what is required at the appropriate time.

6. Privacy

We handle your personal information in accordance with our Privacy Policy and applicable Australian privacy law. Information is used only to identify and recover funds on your behalf.

7. No guarantee of outcome

While we use reasonable skill and care, we cannot guarantee that any particular amount will be recovered, or the time any recovery will take, as these depend on the holder of the funds and your individual circumstances.

8. Limitation of liability

To the maximum extent permitted by law, our liability in connection with the services is limited to the re-supply of the services or the amount of fees paid by you. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
